We do not ship to the following states:

• Alabama (unless shipped directly to a state ABC store)
• Alaska
• Delaware
• Indiana
• Kentucky
• Mississippi
• North Dakota
• Rhode Island
• Utah

We can ship to all other US states. 

We currently do not ship wine outside of the United States, including Puerto Rico.

Weather holds & restrictions:

Severe weather can compromise wine. Wine is a perishable item. We keep a close eye on national forecasts to ensure we ship your wine in the best conditions possible. We may hold your wine shipment due to temperatures that are too hot or cold. We will not guarantee nor replace wine that is weather-damaged once we've advised you of the risk of shipping during inclement weather. 

Specifically, when shipping, if temperatures are above 80 degrees F or below 28 degrees F anywhere on the path of the shipment to you, we will hold the order until more moderate temperatures return. 

If there are any weather-related concerns, we highly recommend upgrading to an expedited shipping option, or simply holding the wines and waiting for temperatures to moderate.  

We will hold all orders placed during the hottest months until the following dates:

• September 19th: CT, HI, IA, ID, IL, MA, ME, MI, MN, MT, NH, NJ, OR, PA, SD, VT, WA, WI, WY
• October 10th: AL, CO, D.C, DE, KS, MD, MO, NE, NM, OH, TN, WV
• October 31st: AR, CA, GA, NC, SC, VA
• November 7th: AZ, FL, NV, OK, TX

All order shipping types will default to either FedEx or UPS ground (except HI), unless otherwise selected or requested. Note, Saturdays and Sundays are not business days for FedEx or UPS ground. 

Ground transit times vary between 1 and 7 business days, depending on the destination. 

We are not responsible for carrier delays regardless of shipping method. 

A tracking number will be provided via email. Tracking information received directly from the shipping company will be the most accurate. We cannot guarantee delivery times; they will vary depending on the shipping type and destination. For date-sensitive orders, please call us directly at +1.832.428.6752.

Wines can be sold and delivered to persons who are at least 21 years old. It is legally required that all alcohol deliveries be received and signed for by an adult of 21 years or older.  Wine shipments cannot be sent to PO Box addresses. 

Some states require we charge sales taxes (state, county, and/or local) on wine shipments.  

Terms: ALL WINES ARE SOLD IN OREGON AND TITLE PASSES TO THE BUYER IN OREGON. We make no representation of the legal rights of anyone to ship or import alcoholic beverages into any state outside of Oregon. The buyer is solely responsible for the shipment of wines. By placing an order with your credit card, you authorize Out of Necessity winery to act on your behalf in processing and shipping the order, including engaging a common carrier to deliver your order. WINES CAN BE SOLD AND DELIVERED TO PERSONS WHO ARE AT LEAST 21 YEARS OLD AND IN PLACING YOUR ORDER, YOU REPRESENT TO US THAT YOU ARE AT LEAST 21 YEARS OLD AND THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD. When your Wine is delivered, the person receiving them will be required to show identification proving that she or he is at least 21 years old.
